Wakf - the religious background:-
The word "Wakf" has its origin in the Arabic word "Waqufa"
meaning to detain or to hold or tie up. It is said that once
second Khalifa Omar acquired a piece of land in Khaibar and
asked the prophet Mohammed as how best to make the most pious
use of it. The Prophet said "Tie up the property and devote the
usufruct to the welfare of human beings, and it is not to be
sold or made the subject of gift or inheritance, devote its
produce to your children, your kindred and the poor and in the
way of Allah".

Wakf means the permanent dedication by a person professing Islam of
any movable or immovable property, for any purpose recognised by the
Muslim Law auspicious, religious or charitable and such wakf are
under (3) categories:(1) Wakf by user such as Graveyards, Musafir
Khanas and Chowltries etc., (2) Wakf under
Mashrutul-khidmat (Service Inam) such as Khazi service,
Nirkhi service, Pesh Imam service and Khateeb
service etc., and (3) Wakf Alal-aulad which is dedicated by
the Donor for the benefit of their kith and kin and for any purpose
recognised by Muslim law as pious, religious or charitable.
The person who has dedicated the property of movable or immovable
for any of the above categories is called “Wakif or Donor”,
once a property is dedicated the Donor looses his entire rights and
such property is not alienated, mortgage or transferable without the
prior permission of Wakf Board.

HYDERABAD: The State Wakf Board has issued
notices to about 2000 persons who have
reportedly encroached upon 423 acre of prime
wakf land near Ramoji Film City on

second such big bunch of notices that has been

The Karnataka State Board of Wakfs chairman, R. Abdul Riyaz,
said that within a month he would make public the names of all

A complaint has been lodged
with the Central Vigilance Commission (CVC) by the Pune
based advocate, Ahmed Khan Pathan, who is also a member of
the Maharashtra State Waqf Board, alleging that

300 crores rupees is facing risk of encroachers in the
Praksham district of Andhra Pradesh. The said property
belongs to the Kandakur Makka masjid Praksham district. The

Mumbai: The Maharashtra minorities ministry has reclaimed
120 acres of waqf land in Junnar, near Nashik, from the
Chougules of the Chateau Indage group.
According to minorities minister Mohammed Arif Naseem Khan,
the land was illegally held by the Chougules for over a
decade.
“This 120 acres originally belonged to the Waqf Board. The
board had made repeated complaints that the land was being
used illegally by the Chougules to raise vineyards and
export wine,” said Khan........

New Delhi: A parliamentary panel Friday recommended
amendments in the Wakf board bill to stop any sale, mortgage

BANGALORE: Deputy Chairman of
the Rajya Sabha K. Rahman Khan on Tuesday urged Chief
Minister B.S. Yeddyurappa to constitute a task force for
resuming prime wakf properties which had been encroached.
Mr. Khan, chairman of the Joint Parliamentary Committee on
Wakf, told presspersons after a meeting with Chief Secretary
Sudhakar Rao on the wakf land issue that three lakh acres of

Some time back the Prime Minister had
appointed a commission under the chairmanship of Justice
Rajender Sachar to take stock of the educational, economic
and social conditions of Muslims in India. This Commission
has made several recommendations in its report about the
welfare of the Muslims. One of the recommendations is the
commercial utilisation of Wakf properties and use their
proceeds for the welfare of Muslims. After the Commission’s
report, the better utilisation of the wakf properties for
the sake of Muslims’ welfare was a hot discussion all over.
Some experiments are also being made in a few states. But on
overall, there is no progress in this regard. To free the
wakfs properties from illegal occupations is also being
discussed over a period........

minorities: Khurshid
New Delhi A proposal to establish
three national universities on Public-Private
Partnership (PPP) model on Wakf land will give Muslims
and other minorities an edge in educational development,
Minority Affairs Minister Salman Khurshid said.
Welcoming the approval given by the Human Resource
Development Ministry for the establishment of these
universities, Khurshid, who is also Chairman of the
Central Wakf Council (CWC) said, "By this we are hopeful
that we would be able to give benefit to the
minorities."
Citing the example of Agra-based B R Ambedkar
University, Khurshid said there was no fixed quota there
for admission of students belonging to Scheduled Castes
because the institution is for them though students from
other communities can also take admission........

TIRUCHI: While initiating legal action against
encroachers of its properties, the Tamil Nadu Wakf Board
would seek allocation of a day in a week for the hearing of
these cases in the courts, the Board Chairman, S. Hyder Ali,

The Tribunals to which the cases had been referred to so far
have not been effective in reducing the pendency. Out of

Hyderabad, January 27: The government has
called for explanations from the State Wakf
Board on some major irregularities that have
been brought to its notice in the selling and
leasing out of the wakf properties in the city
and elsewhere recently. According to sources the
government has been informed of at least three
cases in which the SWB has acted 'indiscreetly'
or even with 'malafied' intention.
One of the major incidents relates to the
Hazrath Ishaq Madani Dargah property in Devada
village of Visakhapatnam district wherein 100
acre land has been given to an educational
institution on a paltry rent of Rs 2,000 per
acre with only Rs 1 lakh as deposit.......

sought answers from the Wakf Board counsel
on three issues pertaining to the Manikonda
jagir lands in Ranga Reddy district in which
projects like Lanco have come up. The
division bench comprising Justice V V S Rao
and Justice Reddy Kantha Rao framed these
queries while hearing rival contentions as
to whether the land in question belongs to
wakf or not.
The questions for which
answers were sought from the Wakf Board
included __ since Manikonda is considered a
Jagir village, what would be the effect of
abolition of Jagirs on this village and

the AP High Court to direct authorities to
carry out chemical testing of soil close to
Mustafa Khan Mosque in Naya Qila to
ascertain whether a graveyard existed there.
Sources said the Hyderabad Golf Association
(HGA) members have now approached the board
and asked it to restrict its claim to the
notified area allotted to the mosque rather
than demanding that the soil be tested.........

The concept of Waqf is rooted to the Quranic injunctions,
which deal with charity. The spirit of charity the Quran
suggests:
"And in their wealth the beggar and outcaste had due
share"(XXVI: 19)
"Ye shall never attain to goodness till ye give alms of that
which ye love, and whatever ye give, of a truth God Knoweth"
(III: 86). (Text Book of Mohammedan Law by Aqil Ahmad, 2001,
Page 269). The followers of Islam transformed this concept
of charity into an institution known as Waqf that formed the
"most important branch of Muslim Law for it is interwoven
with the entire religious life and social economy of the
Muslims" (Ibid. Quote from Amir Ali, Muslim Law, Vol. I,
Page 207).

being made two years ago regarding 100 files relating to
waqf properties worth millions, missing from the AP Waqf
Board Office located at the Hajj House, Nampally, and the
concerned authority having issued an inquiry order at that
time the staff of the Board has failed to recover these
files or submit an inquiry report. When contacted in this
regard, the CEO of the Board, M. Habib Ahmad, explained that
the matter was quite old and no inquiry order had ever been

New Delhi After a hiatus of
more than two years, the Delhi Wakf Board, which is supposed
to administer and manage more than 300 properties in the
Capital, looks set to come alive again. Nudged by the Delhi
High Court, the government has nominated three members of
the Wakf Board — paving the way for the body to become
functional. The government has taken this step after a delay
of more than six months.
Justice Vipin Sanghi disposed of a petition filed by the
United Front for the Protection and Welfare of Auqaf on
Tuesday, after the government apprised the court about the
nomination, and submitted that the Board could now start

SC stays Bombay HC order
dissolving Maharashtra Wakf Board
New Delhi, Nov 29 (PTI) The Supreme Court today stayed a
Bombay High Court judgement dissolving the Maharashtra State
Wakf Board, which administers all Muslim religious trusts in
the state.
A bench headed by Justice Altamas Kabir issued notice to all
those including Anjuman-e-Islam trust, which had challenged
the constitution of the state board in the high court.
The high court had dissolved the Board after holding it as
"defective". Actress Shabana Azmi was one of the members of
the Board.
The Maharashtra government and the Wakf Board challenged the
September 21 verdict.........

Under Muslim
rule in India the concept of Waqf was more widely
comprehended as aligned with the spirit of charity endorsed
by the Quran.
Waqf implies the endowment of property, moveable or
immovable, tangible or intangible to God by a Muslim, under
